Michael P. McIlhinney focuses his practice on real estate development with an emphasis on zoning and land use matters, real estate, real estate litigation, and complex real estate transactions.

Mr. McIlhinney is experienced in representing clients in zoning and land use matters, as well as a broad range of real estate and commercial litigation matters before the Pennsylvania and New Jersey federal and state courts and various governmental agencies, including Departments of Licenses & Inspections, zoning boards, civic associations and other city and township departments and boards. Mr. McIlhinney’s litigation practice includes the defense of individuals and companies in cases alleging business torts, consumer fraud and deceptive trade practices, and breach of contract actions.  Mr. McIlhinney is also experienced in representing neighbors and non-profit organizations in actions to appoint conservators of abandoned and blighted property to ensure the properties are returned to productive use.

Some of Mr. McIlhinney’s recent representations include:

  • Successfully obtained zoning relief for a church in North Philadelphia.
  • Represented a street cart vendor in a successful appeal of the Philadelphia Department of Licenses and Inspections revocation of vending license in violation of client’s due process rights.
  • Represented a developer in an action seeking specific performance of a real estate sales contract.
  • Successfully defended an eviction action on behalf of a tenant in Philadelphia Landlord-Tenant Court.
  • Representing a non-profit corporation in seeking court appointment of a conservator to repair imminently dangerous buildings in the Bella Vista Neighborhood of Philadelphia.
  • Representing a property owner in seeking court appointment of a conservator to repair a long abandoned property in the Francisville Neighborhood.
  • Representing a regional bank in preparation of loan documentation for construction loan.
  • Drafting and reviewing transactional documents for the sale of a large commercial building in the Chinatown section of Philadelphia.

Background. Prior to joining Orphanides & Toner LLP, Mr. McIlhinney was a litigation attorney in the Philadelphia office of large international law firms where he defended pharmaceutical and consumer product companies against mass tort claims, and represented life insurance carriers in the prosecution and defense of claims arising out of stranger originated life insurance.

Bar Memberships.  Michael is licensed to practice law in Pennsylvania and New Jersey.  He is also admitted in the U.S. District Court for the Eastern District of Pennsylvania and the U.S. District Court for the District of New Jersey.

In General.  Michael graduated Magna Cum Laude from Villanova University School of Law in 2004, where he was a finalist in the Reimel Moot Court competition.  He received his undergraduate degree in Biology from the Ursinus College in 1999.
